Govt. to move SC against order on POTA detenus

CHENNAI March 31 . The Tamil Nadu Government will soon file a special leave petition in the Supreme Court against the recent Madras High Court order that POTA detenus, including the Tamil nationalist leader, P. Nedumaran, are entitled to move the appropriate forum for bail since charge sheet had already been filed in their cases.

Stating this in the Assembly today, the Chief Minister, Jayalalithaa, said the Government also appointed an Additional Solicitor-General to represent the State in the Supreme Court where the MDMK leader, Vaiko, had challenged Section 21 of the POTA. As the issue involved Constitutional provisions, the Additional Solicitor-General would represent the State.

She said so far 42 persons had been arrested in the State under the POTA, of which 41 had been detained under the judicial custody, as per the Special Court order.

The remaining one was released on bail by the High Court.

The State, she said, had registered eight cases under the POTA, out of which charge sheet had been filed in four cases, including against Mr. Vaiko, Mr. Nedumaran and Pavanan. Investigation was going on in the remaining cases, involving 44 naxalites belonging to PWG group, she said.
