HC stays directive to PSC secy.

KOCHI DEC. 17. The Kerala High Court on Tuesday stayed a directive issued by the Legislative Secretary to N. K. Krishnankutty, Secretary, Kerala Public Service Commission, to appear before the Committee on the Welfare of Backward Class on December 19 at 11.30 a.m. Justice M. Ramachandran issued the interim order on a writ petition filed by Mr. Krishnankutty, challenging the order of the Legislative Secretary.

He has been asked to appear before the Committee as it wants certain details on some issues.

The petitioner sought a declaration that the PSC secretary was not amenable to the jurisdiction of the Legislative Secretary.

When the petition was taken up today, the Government Pleader opposed it, saying that the petitioner could not claim any privileges.In fact, the petitioner had raised certain points to be considered - whether the Legislative Secretary could summon the Secretary to appear before the Committee on the basis of newspaper reports; whether the Government could direct the Secretary to appear before the committee and whether on the basis of Government opinion, the Legislative Secretary could summon the Secretary to give evidence.
