The Special Judge, N.K. Balakrishnan, while dismissing a complaint filed by a private person, Jomon Puthenpurackal, noted that the issuance of two orders by the Managing Director of the AVRC in this regard appeared to be irregular and may be termed as an act of favouritism. However, the offence would not come under the provisions of the Prevention of Corruption Act and the Indian Penal Code because the beneficiary had not obtained permanent employment on the basis of the orders referred to, the Judge said. Apart from Mr. Soopy, the AVRC Managing Director, Saleem, and the daily wage employee, Shamla Ismail Nasim, a resident of Keralapuram in Kollam, had been named as respondents in the complaint. According to the complaint, Mr. Saleem had issued an order on August 23, 2001, transferring Ms. Nasim from the AVRC's Tirur Sub-Centre, where she was working as a daily wage proof-reader, to the head office in Thiruvananthapuram. On the same day, he had issued another order posting her at the Sub Centre in Kottayam.
