SC rejects plea for President's rule in Gujarat
By Our Legal Correspondent
NEW DELHI
Dec. 9.
The Supreme Court today dismissed a public interest petition seeking imposition of President's rule in Gujarat on the ground that there was no provision in the Constitution for the continuance of Narendra Modi as caretaker Chief Minister.
A Bench comprising Justice V.N. Khare and Justice Ashok Bhan dismissed the petition filed by Yogesh Dahyabhai Sridhar after hearing the Solicitor- General, Kirit Raval.
Mr. Raval brought to the notice of the court that a Constitution Bench had recently given its opinion on the three-point Presidential reference on Gujarat. In view of that advisory opinion the present petition had become infructuous, he said and sought its dismissal.
