A Division Bench of the Court comprising Justice V.S. Aggarwal and Justice V.K. Majotra asked the respondents to file their respective replies by June 26. The petitioner, K.K. Sharma, through his counsel Surat Singh said that the department had foisted a false case upon him and denied promotion to him to the rank of Motor Licensing Officer on that ground. Dr. Singh submitted that the fact was that his petitioner was absolved of all the charges by an enquiry committee appointed by the department. He submitted that the department should have promoted the petitioner to the rank of Motor Licensing Officer when the charges against him were dismissed. On the contrary, the department gave promotion to his juniors and asked him to report to them. Such action on the part of the department was illegal, arbitrary, unjust and deserved to be set aside and the petitioner should be promoted to the post of Motor Licensing Officer, Dr. Singh submitted.
